There are many makes and models of boats and variations year on year. Whilst Hamilton Innovation Ltd will provide Alternatively, and at your option, we will replace the product with the same, or a similar product (subject to stock availability).advice and guidance on the suitability of the Habitent unit for your boat, it is ultimately the clients responsibility to ensure that the unit will fit their boat. We do not offer a refund unless the goods are faulty or not of merchantable quality. Making a purchase from Hamilton Innovation Ltd should be straightforward. Postage and packaging
Postage and packaging costs will be added to your order at this point. You will be asked for a few details before we can complete your order. If you make a mistake in the order and need some help to correct it, contact us and we will help you correct it. You can also place an order by post to the above address. Your order should be accompanied by a cheque for the payment in full for the goods, postage and packaging to the correct value. Please request confirmation of the value of your order first by emailing us at firstname.lastname@example.org. Orders will not be dispatched until cheques have been cleared. We will forward a confirmation of the order; this is to let you know that we have received your order. Only when we send you an invoice detailing the items you have ordered, confirming the final costs and accepting your order will a contract exist between us. In the interest of fair practice, we reserve the right not to fulfil any order if we believe it would not be in our interests to do so.
Occasionally items are not immediately available – If your item is not in stock, we will place your order on a wait list for you. You will always be emailed with the option to cancel your order if you would rather not wait.
All prices are in pounds (£) sterling, inclusive of UK VAT (where applicable), but exclude delivery charges. Product prices are inclusive of VAT at the current UK rate for orders made from the UK or the European Union. If you order products for delivery outside the United Kingdom, they may be subject to import duties and taxes; you will be responsible for these. Delivery charges will be added to the total amount due, they are automatically calculated and added to your order. You will see the total amount you have to pay before you confirm the order. In the unlikely event that the price of a product has been incorrectly advertised, we will contact you to ask whether you wish to proceed with the order at the correct price. If you are not happy to proceed, or we are unable to obtain your instructions, we will cancel your order. We will not be obliged to supply products at the incorrect price.
All on line transaction are processed using a PSP a Payment Services Provider. We accept payment through Pay Pal or cheques, goods will be dispatched once payment has been authorised. Cheques have to be cleared before dispatch of the order. Cheques and your written order can be sent to the Address at the top of this notice. We will not charge you for any goods until they are dispatched.
We will confirm the dispatch of your order by e-mail, we aim to despatch goods in stock within 5 working days. You must inform us within 7 days of the dispatch date if the goods are lost or damaged in transit so that we can make a prompt claim against the delivery company and correct the problem. Please quote your order number in all correspondence. A signature is required when you receive your order. If you are likely to be out, please give an alternative delivery address. You agree that for proof delivery, a signature of the recipient (or someone on their behalf) rather than a 3rd party supplied by our delivery company is sufficient evidence to establish that goods have been received.
Note For orders to mainland Europe and Rest of World
The cost for carriage is calculated on order package weight and final destination. The price will be calculated and shown clearly as part of the order process.
Guarantee & Returns Policy
Your rights to return goods are protected under the EU Distance Selling Directive. If you wish to return your order, do this by contacting us by email or telephone and quoting the order number supplied to you.
The Seller warrants that the Goods will at the time of delivery correspond to the description given by the Seller.
If you wish to cancel your order because it did not meet your expectations or was incorrectly ordered you must notify us within 7 working days after the date of delivery quoting your order reference number. You must take all reasonable care of the product while in your possession. This means you can inspect the products but you must not use or damage the products supplied to you in any way. The products must be unused and in their original saleable condition. You are responsible for the cost and risk of loss or damage when returning the goods, so you should take out enough postal insurance to cover their value. If you are returning goods because you wish to cancel your order or the goods did not meet your expectations, then you will pay the return postage costs. Your product refund will be paid within 30 days.
If you would like us to replace the goods with another size, we will charge carriage on the replacement.
This cancellation policy does not affect your rights when we are at fault – for example, if goods are faulty or incorrectly described.
Alterations and Modifications
Any unauthorised alteration or modification will negate the 12 month warranty and will exclude Hamilton Innovation Ltd from all liabilities arising
If you return an item because it was faulty when it was delivered, please notify us quoting your order number within 7 workings days of the date of receipt of the order. We will refund your postage costs for delivery and returning it to us. Please check with us before returning any goods, as we will only refund the basic postage charge. If the product is to be returned by post, please remember to obtain proof of posting. Please allow 21 days from our receipt of your product for your refund to be processed or a replacement product to be despatched
We will also refund the purchase price together with the delivery charge for a product, which develops a fault within a period of 12 months from delivery (other than due to normal wear and tear, failure to follow instructions or misuse). Examples of damage that is not covered: Permitting water, snow or ice to pool or puddle on the product. Tears or rips caused by over tensioning the product or failure to protect the product from sharp objects. Wind damage due to improperly tying down the product. Fabric discoloration or failure, due to chemical exposure (includes tree sap, bird droppings, oil and gas, other local pollutants and chemical cleaners). Mildew caused by dirt resting on the product or the product being stored whilst wet.
Alternatively, and at your option, we will replace the product with the same, or a similar product (subject to stock availability).
USAGE OF THE PRODUCT AS A BOAT STORAGE COVER
THE UNIT MUST NOT BE LEFT UNATTENDED FOR A PERIOD EXCEEDING 24hrs
Limitation of Liability
We will not be liable to you where performance of any of our obligations is prevented or restricted by any circumstance or cause beyond our reasonable control, such as Ash Clouds. You would still have your Sale of Goods Act and Distance Selling rights to claim a refund.
You are responsible for the use you make of the products you order. To the extent not prohibited by law, we accept no liability for any loss, which is not reasonably foreseeable, or for any business loss (which includes loss of profits, contracts, goodwill, opportunity and other similar losses).
Our policy at Hamilton Innovation Ltd is to respect the privacy of our customers at all times. We adhere to the UK Data Protection Act and comply with its terms. Information is collected lawfully and in accordance with the Data Protection Act 1998.
If you place an order with us, or sign up to be placed on our e-mailing list, we will place you on our mailing or e-mailing list and may from time to time send you details of promotions or other information which we feel would be of interest to you. If you do not want to receive such information, please contact us: email@example.com putting “Unsubscribe” in the subject line.
Your address, e-mail address, telephone number and other details will not be made available by us for use by any third party. We will only use this information ourselves to contact you on matters relating to your orders, or if we have future offers which may be of interest to you.
